PURCHASE RULES
The rules of the online store www.amoti.lt define the conclusion of the purchase agreement and the obligations of the parties.
1. General Provisions
1.1. These purchase and sale rules (hereinafter – the Rules) establish the rights, obligations, and responsibilities of the person purchasing goods in the online store www.amoti.lt (hereinafter – the Buyer) and the Seller, when the Buyer purchases goods in the online store. By purchasing goods in the online store, the Buyer agrees to the application of these Rules.
2. Conclusion of the Purchase and Sale Agreement
2.1. The purchase and sale agreement between the Buyer and the Seller is considered concluded from the moment the Buyer, having formed a shopping cart in the online store, provided information about themselves (name, surname, delivery address, email, phone number), selected a payment method, familiarized themselves with these Rules, and clicked the “Order” button. The agreement remains valid until all obligations under it have been fully fulfilled. If the Buyer does not agree with all or part of the Rules, they must not place an order.
3. Seller’s Rights
3.1. The Seller has the right to temporarily or indefinitely suspend the operation of the online store, having informed the Buyers in advance, and undertakes to dispatch the goods already paid for by the Buyer.
3.2. The Seller has the right to unilaterally amend these Rules by publishing the amended Rules on the online store’s website. The changes take effect from the moment of publication and apply to all transactions concluded thereafter.
3.3. The Seller has other rights provided in these Rules and in the laws of the Republic of Lithuania.
4. Seller’s Obligations
4.1. The Seller undertakes to make efforts to enable the Buyer to properly use the services provided by the online store. The Seller does not guarantee that the online store will operate without interruption or that data transmission will be error-free. The Seller is not liable for any losses incurred by the Buyer due to malfunctions of the online store and/or data transmission errors.
4.2. The Seller undertakes to dispatch the goods ordered by the Buyer within 7–10 business days from the date of payment.
4.3. The Seller undertakes to exchange goods purchased by the Buyer free of charge if they are of the wrong size, for analogous goods of different dimensions, shape, color, model, or complexity. If the Seller does not have suitable goods for exchange, the Buyer has the right to return the goods to the Seller and receive a refund. In such a case, the Seller undertakes to refund the Buyer within 10 business days and is released from liability for non-delivery of the goods.
4.4. The Seller undertakes to comply with other requirements set forth in these Rules.
5. Buyer’s Rights
5.1. The Buyer has the right to purchase goods in the online store in accordance with these Rules and the laws of the Republic of Lithuania.
5.2. The Buyer (consumer) has the right to withdraw from the purchase and sale agreement concluded in the online store with the Seller by notifying the Seller in writing within 14 business days from the date of delivery. The Buyer may withdraw from the purchase and sale agreement with the Seller only if the goods are of good quality, undamaged, unused, and their appearance has not substantially changed.
5.4. The Buyer has other rights provided in these Rules and in the laws of the Republic of Lithuania.
5.5. Payments can be made using the electronic banking services of Swedbank, SEB, Luminor, Citadele, and Šiaulių bankas. Payments are possible in euros. Payments are processed through the MakeCommerce.lt payment platform.
6. Buyer’s Obligations
6.1. The Buyer must pay the price of the goods and delivery, as well as other payments (if specified in the contract), and accept the ordered goods.
6.2. Goods are produced and the Seller begins to fulfill the purchase agreement only after receiving confirmation from the Buyer’s bank about the completed payment.
6.3. The Buyer must comply with other requirements set forth in these Rules and in the laws of the Republic of Lithuania.
7. General Liability
7.1. The Buyer is responsible for the accuracy of the data provided. The Buyer assumes responsibility for consequences arising from incorrect or inaccurate data.
7.2. For violations of the purchase and sale agreement concluded via the online store, the parties are liable as provided by the laws of the Republic of Lithuania.
7.3. The Seller is not liable if the goods displayed in the online store differ in color, shape, or other parameters from the actual goods due to the characteristics of the Buyer’s display device.
7.4. The Seller is not liable for changes in the quality of clothing if the Buyer used it without following the washing or care instructions indicated on the label.
7.5. The Seller warns that when wearing or washing clothing, the fabric’s color, texture, or other properties may change.
7.6. If damage occurs, the guilty party compensates the other party for the direct losses caused by its fault.
8. Processing of Personal Data
8.1. By clicking the “Order” button, the Buyer confirms that they and their representatives (with their consent) agree to provide their personal data to the Seller and do not object to the processing of such data by the Seller for identification, contract conclusion and execution (online trade), and direct marketing purposes. The Seller states that personal codes of the Buyer (if a natural person) and representatives will not be processed for direct marketing purposes.
8.2. By clicking the “Order” button, the Buyer confirms that they (if a natural person) and their representatives are informed of their right to access, correct, delete, or suspend the processing of their personal data if it is processed unlawfully, and to object to its processing.
8.3. By clicking the “Order” button, the Buyer confirms that they and their representatives know they have the right to refuse to provide their personal data but understand that such data is necessary to uniquely identify them for contract conclusion and execution (online trade). Without providing personal data and/or consenting to its processing, the Buyer will not be able to conclude and/or execute the contract.
9. Sending Information
9.1. The Seller sends all informational and marketing messages to the email address provided in the Buyer’s registration form.
9.2. The Buyer sends all notifications and inquiries to the Seller’s contact details provided in the online store.
10. Final Provisions
10.1. The Buyer and the Seller agree that all information provided on the Seller’s online store website (including, but not limited to, these Rules, Seller’s details, offered goods and services, their characteristics, Buyer’s right of withdrawal procedures, maintenance services, and warranties, if provided) is considered delivered to the Buyer in writing.
10.2. All disputes arising from or related to the purchase and sale agreement between the Buyer and the Seller shall be resolved through negotiations. If an agreement cannot be reached, disputes are settled according to the laws of the Republic of Lithuania.
